A few days ago, a friend popped round to get a copy of some pics from a night out. Knowing he was coming I accidentally (yeh, right) left a folder with my wife topless open. So when the screen popped up there she was. He was most grateful.

Nearly all of the pics had the women in some kind of sexual situations with men that weren't their husbands and a lot of the women were with black men. I understood why the guy didn't want anyone to find the files. I showed the pictures to my wife and she recognized a couple of the black guys in fact my wife had fucked both of the guys previously. To finish the story we never told anyone about the pictures so no one got into any trouble over them but I always wondered what the story behind them was.

seems to me that a little coercion and you could have had an interesting sex session! you could have used this against my lady for some favours!

You bought the phone and, absent any contract to the contrary, you own what's on it. You don't own exclusivity - if they have copies backed up on their mac or whatever, they own those, but they gave you everything on the machine when you bought it.

The joy of our legal system is that they could still bring a charge against you if they found out and bothered, but it'd be along the lines of "invasion of privacy" which is at best a state-by-state concept that is often weakly defined. They wouldn't have a great case but anyone can sue for anything, even if it gets summarily thrown out.

You do legally own everything on it, so if you want you can freely post it, or not its your choice,

Not necessarily correct. From a contract perspective, it is clear the previous had no intention of selling or gifting the pics and vids to the recipient. It is clearly a mistake without inte t to transfer ownership of the pics or vids. There is also an invasion of privacy issue from a legal perspective.

Even if he did, from a copyright perspective he is not "freely post it". The previous owner transferred ownership of a copy of a copyrighted work. However, he did not license the right to make further copies, or to publicly display the work. And, aside from copyrigbt, there is still an invasion of privacy issue.

A girl I went to school with is selling her I Phone 6 and I have said I might buy it. She 100% has taken lots of nudes on the phone but will have deleted them. She won't have gone any further than deleting and then deleting recently deleted. Would I still be able to definitely recover pics from there? I don't want to waste £200 on a phone for no bloody reason
