Purchasing the ticket and setting foot inside the event is entering into the contract you describe. On the back of every ticket is printed the terms and conditions relating to photography and the usage thereof. Failure to comply with those terms is treated as trespass by the organizers and they take legal action when such trespass is committed.

Burning Man is not a public event. Since it is a private event held on private property (for which you must pay hundreds of dollars to attend) it is well within the rights of the Burning Man organizers to control all photography and complain if that control is breached.

According to this article, until at least 2013, and maybe beyond, it was not held on private property. And there is a big difference in terms of what you can legally enforce photographically on private vs public property.

I mistyped, I meant to put "private event on public property". But the public property angle is a red herring in regard to photography. Every participant in this private event agrees to Burning Man (BMP) being assigned joint ownership/copyright of all photos taken at the event. Acceptable "personal use" is defined and anything other than that is a breach of BMP copyright.

All this is moot. OCC (being the recipients of any takedown notices) gets to decide the policy of this website in regard of BM photos and the position it has taken is crystal clear.
