If you post pictures on here, then you will destroy any case that you have right now. Especially, if you have to go to court with this. DO NOT POST YOUR PHOTOS. Even though people continue to ask to see them.

Hello Daskers.

Please tell us the full story. How did they get a hold of his pics and did he get them back? I am interested to know. Thanks.

I didn't quote you anywhere, but it seems we are agreeing anyways.

Default Be Really Careful

At my work most of us receive a stipend for using our own cell phones for work also instead of carrying 2 phones. There was an investigation at work that required the legal department to review email messages. Because we are paid to use our cell phones they claimed the right to check the phones for messages relating to the investigation. A coworker had some porn pics on his and was fired. The company has a policy that possession of porn at work is a termination offense. He did consult a couple of lawyers and they basically said he was screwed. Since then we have all dropped the stipend and gone with a strictly work phone.

You have no privacy in company equipment. They can search it remotely and never tell you. one hundred percent legal. However many companies give you more privacy than the law allows.

Suing for your lost stick is not likely to go anywhere. See theres a thing called contributory liability. How liable is the party suing? You lost your stick. So your own negligence was the primary vehicle. Not saying they wouldnt be liable just saying its not such a clear case.

However I would definitley demand it back and state that you want it back as any you fear the risk of publication. Their possession of the stick makes them responsible.

Being fired: In most all states, absent a contract or a union, they can fire you for ANY reason, except race, creed, religion, sex. Any other reason. Its called 'at will' employment.

Now that doesnt mean that they do. Thats just the law.
