Ms Simpson, 33, a British tourist, said she had been discriminated against because her breasts were deemed offensive.
Human Rights Commission spokesman Gilbert Wong said Ms Simpson was welcome to make a complaint. However, physical appearance – including breast size – was not a criterion for discrimination under the Human Rights Act. Mr Wong said Christchurch Casino appeared to be enforcing its dress code, which it had a right to do. Wellington civil liberties lawyer Tony Ellis said he did not believe Ms Simpson had solid grounds to argue she was discriminated against. Though rules that prohibited excessive displays of cleavage might adversely affect one section of one gender group, they were a result of prevailing moral standards. Mr Ellis said the casino was entitled to regulate the behaviour of its patrons – including ensuring that what they wore did not offend others. "Some punters don't want to be distracted while they gamble." The casino's website said its dress code required patrons to wear smart, neat attire at all times. |
