It seems that this part of the law was overturned as "too vague" but the US Government was appealing it to the Supreme Court. No word on if they actually accepted the case, it was supposed to have happened in October 2007.
I would point out that according to this version of the law, Ranma 1/2, Bleach, Naruto, etc could all be considered Child Pornography. Each one of them has things that, if you're prudish enough, could be considered "sexually explicit conduct" -- Ranma-chan going topless, Yorochi sitting cross legged naked in front of Ichigo, Naruto doing the 1000 years of pain with exploding daggers to Gaara, etc etc.
