Yes, that's theoretically in the Spanish Constitution, but not what it seems. It's legal to be naked anywhere in the UK too, according to law. But will you attract the attention of Plod? Or the Guardia Civil? Yes.
Will you end up in court? Probably. Fined? Yes.
What it means by 'legal to go naked anywhere' is that you exercise discretion when choosing
any beach, for example, to skinny dip on. I've done this. Just stopped at the side of the road, stripped off, swum, got dressed and driven on. Perfectly 'legal' within the Spanish Constitution. I don't need an 'FKK' sign or 'Playa Nudista' sign to do that. I can swim anywhere without a costume. Or walk in the mountains equally nude.
But if you decide to strip off on a crowded, textile beach in the centre of one of the coastal towns...you may face difficulties and disapproval from other textile beach users.
It's all about discretion and the feelings of others. If I strip off outside a church as a number of nuns are leaving a church service, I expect the attentions of the police, and rightly so. It's the law to be naked anywhere, but within that is the right not to offend others.
However, if I'm skinny dipping and emerge from the sea just as a number of nuns are coming down the path, and they happen upon me drying myself off, I do not expect the attentions of the law, because I've just been swimming naked and the nuns have chanced upon me. I didn't set out to offend or be an exhibitionist in this instance. See how it works?
If you decide to strip off in a mall, or in the beach bars and restaurants of Playa del Ingles, DO expect the attentions of the law pretty quickly.
