Even if he did, from a copyright perspective he is not "freely post it". The previous owner transferred ownership of a copy of a copyrighted work. However, he did not license the right to make further copies, or to publicly display the work. And, aside from copyrigbt, there is still an invasion of privacy issue.

This is an incomplete understanding of copyright law and contracts.
Absent a sales contract, it's not at all "clear" that there was no intent to transfer the files.
Again, absent a license agreement, no rights were reserved when he sold the phone. A sale transaction without a contract doesn't reserve those other copyrights.
Bottom line - do what you want, but we'd love to see the contents!
