Absent a sales contract, it's not at all "clear" that there was no intent to transfer the files.
Again, absent a license agreement, no rights were reserved when he sold the phone. A sale transaction without a contract doesn't reserve those other copyrights.

Bottom line - do what you want, but we'd love to see the contents!
