Technically speaking, every photo is copyrighted as soon as it's taken - even without any notice on it. This area of law is very clear, but in practice it's all about who cares to spend the money to threaten enforcement. Private use is almost never a problem (you are making a copy of any image your browser puts into it's cache for viewing), but it's when people widely spread photos currently in commercial use, that you tend to get copyright holders' attention.
