How much trouble would i get in?
Ok guys check this. I have been talking to this chick and she gave me a few pictures of her naked. Teased the hell out of me and then ditched me for some other guy. How much trouble could i get in for posting those pictures?

*****EDIT: Uh oh, that was me speaking as someone who wants to see the pics, not as a mod. :o ::checks over shoulder:: |
Honestly, the most trouble you could get in is if she tracks you down to your house and kicks you in the "delicates". Uh, other than that? Bring on the piccies!
*** Ok, yeah, me too speaking as someone who wants to see the pics. I honestly can't remember the exact rule on this. I think as long as there is no e-mail address or otherwise identifying info along with the pics, it is OK. I think it is only in the "Ladies of OCC" section where you can't post girls without their knowledge. There have been other pics of girls posted by those who knew them in the past (e. g. Stephanie Bond), so I think it should be OK. *** Fango |
- Did she state any restrictions when she gave you the pics? If not, then post away, they were a gift to you.

and hopefully soon a gift to us!

it depends on your attitude and moral standings. personally, if there are any identifying things in the pic, i'd make an attempt to obscure it. it is a judgment call but saying that, she did give you do the pics, it's only right you should share. :D
|
you got `em..share `em!!!!!!!!!!!!!!!!!!!!! :) :p :D
|
If it was me, i wuldn't hesitate to share...... :D

I'm smelling TROLL here.
TROLL (def: Someone who just says things or makes promises (usually all untrue with no intention of following through) only for the sake of getting a response from people, or to see how many responses he/she can generate from a thread, or to start some sort of argument.) If you're not a Troll start a' postin'! |
Maybe he just has second thoughts....
I had posted a single picture from a large set I had of my ex... and honestly it toook a long time to get a feel for this site and the people.... enough to take the risk of posting. As a person who's also hmmmmm'd and haaawwwwd about wether to post or not Mtmurdic, I can tell ya that if your ever going to post pics of your ex. This is the website to do it. |
posting pics
I've always heard that if the woman knowingly and willingly posed for pics and/or agreed to be video-taped and did not ask for the pics or vid back or did not specifically mandate that no one else see them or that they be destroyed, they were yours to do with as you pleased. Can anyone confirm that?

I have only one question -
Are they worth posting? |

You can do what you want with them, except sell them. You need a release for that. I like the angle the girls gone wild lawyers take, that filiming women naked in public is newsworthy, so they dont need releases, and they dont need permission. But i digress. |

Hey thanks for posting! She's very sexy... I love her facial expressions.
|
Now that's what I'm talkin' about! :D Great pics! Keep em' coming!

Post Them
I believe the law is that as long as your not gaining monetary ($$) compensations from the pictures she has no legal standing. Think of all the pictures of ex wives and girlfriends on the internet and those girls know who put them up there. I think your safe unless she can find a friend to knock you around a bit! :)

Very sexy......
Great set of pics |
Without a Model Release, you could be in a lot of trouble
I live in Canada, but I doubt the laws are any different elsewhere. If the girl is recognizable and has not given written permission to use her image, you can be sued for anything from pictorial libel/slander to malicious intent.
The law states that if you took the pictures, YOU own the pictures, and she cannot demand they be given to her. However, SHE owns the image on the pictures, and if she has not given written permission for them to be used in the manner in which you are using them, you can be held liable. The fact that she allowed you to take and/or keep them only means that she allowed you to have them. It does not mean she has given you permission to distribute them in such a way that she can be embarassed. She is not a newsworthy person in her own right, and unless the images themselves are newsworthy because of their content, she has the right as a private person to keep her self-respect. I photograph many models doing lots of things they don't want their mothers etc. to find out about. While some of these have been taken in public, the girl knew at the time what she was doing, and that there was a limited number of people likely to notice. Posting them on a website means that they are in cyberspace forever, and as word spreads about them, family and friends will become aware of them and cause embarassment. (Having said that, I have complete signed and dated Model Releases on all my models and block out the faces simply because I have found that while the girls may be all in favour of the photos at the time they were shot, a year later they don't necessarily have the same opinion, and while I have the LEGAL right to publish their photos in any manner I wish, I prefer not to embarass them unnecessarily because they had a few hours of fun a few years ago). Yes, you do see GGW etc sites that publish photos of girls who have not given their permission to do so. The argument they use in court is that the pictures are newsworthy. That is just the argument they're using against an ongoing lawsuit. It has not been found valid or invalid yet. I suspect they will lose simply because while the photos themselves may be interesting, they are not of and by themselves newsworthy. They are simply a commercial enterprise. I suspect they will lose their arguement. My suggestion is that if you have any suspicion that the girl involved will be hurt or embarassed by the photos, you might be best to remove them to save her a lot of pain and to save you possible legal proceedings. |
I think we should run this one by Judge Judy.
Nice pics by the way mtburdick! :D |
