However, he did not license the right to make further copies, or to publicly display the work. And, aside from copyrigbt, there is still an invasion of privacy issue.

This is more in the area of what I see on other's phones. I do IT for a sales company that has a large staff of mostly females <35 y/o. I will say I generally respect my client's privacy, but it pisses off the owner when they load up their company phones with non-work related apps, photos and music.
