By default, yes. In some jurisdictions an arrest for public indecency will get you placed on a sex offender list. Whether you would get arrested or warned depends on particular police department/police officers and not worth the risk. Haulover Beach just north of Miami Beach has a legal nude beach. South Beach allows toplessness by custom, though there is no actual law permitting it. Gunnison Beach is famous legal nude beach in NJ. Part of Black's Beach in California is also legally nude. Vast majority of beaches in USA allow neither toplessnes nor nudity.
